Goods are sold via the website www.albumdifamiglia.com in accordance with the following conditions:
\n1. SELLER
\nAlbum di Famiglia S.r.l. (VAT No. 03084220130 \u2013 Economic & Administrative Index No.: CO-0295262), based in Lomazzo (CO) in Via Del Ronco 12.
\n2. BUYER
\nAny adult may order goods shown in the online catalogue.
\nThe buyer is obliged, subject to their own liability for false or incomplete declarations, to provide to Album di Famiglia their personal and fiscal details.
\n3. PURCHASE OFFER
\nPublication on the www.albumdifamiglia.com website of individuals products, with their respective description and price, constitutes only and exclusively an offer invitation.
\nThe buyer may order items published in the online catalogue by completing the following steps:
\n\u2013 register on the site by clicking the \u201cREGISTER\u201d icon and provide all requested details (or, if already registered, log in by entering your username and password);
\n\u2013 select and add to your basket the products you wish to purchase, identifying their size, colour and quantity, by clicking the \u201cADD TO SHOPPING BAG\u201d icon next to each product;
\n\u2013 check the accuracy of the data (in particular the number, size and colour of each ordered item) included on the order form;
\n\u2013 send the order to Album di Famiglia by clicking the \u201cPROCEED\u201d icon;
\n\u2013 select the \u201cACCEPT SALE CONDITIONS\u201d icon and then \u201cPROCEED\u201d;
\n\u2013 click the \u201cCONFIRM\u201d button;
\n\u2013 pay for the ordered goods by selecting the preferred method from those available (advance bank transfer or Pay Pal); Once the transaction has been successfully completed, the screen will show a notification stating that the order has been sent.
\n4. CONTRACT FINALISATION
\nOnce the order has been received, Album di Famiglia shall inform the buyer, by way of e-mail to the address identified on the order form, whether or not the order is wholly or partially accepted.
\nThe contract shall in any case be finalised only upon receipt by the buyer of an order confirmation from Album di Famiglia.
\n5. PARTIAL ACCEPTANCE OF ORDER
\nWhere, due to stock shortage or other reasons, Album di Famiglia is only able to accept part of the order received, it shall inform the buyer within the order confirmation.
\nUnless otherwise notified by the buyer within 10 days of receiving the order confirmation, the contract shall be deemed to be finalised only for the sale of the goods identified within the order confirmation and Album di Famiglia shall return to the buyer the cost of the other goods.
\n6. SENDING THE ORDER CONFIRMATION
\nAny information relating to the order and the contract shall be notified to the buyer by way of email and shall be stored in the Album di Famiglia database. In the event of non-delivery or accidental loss, the buyer may request a copy of such by writing to shop@albumdifamiglia.com.
\n7. DELIVERY
\nAlbum di Famiglia will send the goods by way of courier to the buyer within 30 days from the day after the order is sent.
\nIn the case of replacements or modifications, agreed in accordance with point 8, to the ordered items, the delivery period shall commence from the date of agreement to the modification.
\n8. CONTRACT MODIFICATIONS
\nAny modifications to the number of goods, their size, colour and any other contractual element must be agreed between the parties.
\nTo this end, the buyer must contact Album di Famiglia via the email address shop@albumdifamiglia.com or by recorded delivery letter with acknowledgement of receipt sent to Album di Famiglia in Lomazzo (CO) in Via Del Ronco 12.
\n9. PRICE
\nThe price must be paid when the order is sent; Album di Famiglia shall not process any order unless payment has been received for the ordered goods, delivery costs and any other charges.
\n10. SHIPPING
\nShipping costs, as specified in the order form, shall be paid by the buyer. The buyer shall also be responsible for the risks of loss and\/or damage to the goods once they have been shipped by Album di Famiglia.
\n11. TAXES AND CUSTOMS DUTIES
\nWhere the ordered goods are to be delivered to non-EU nations, any taxes and\/or duties and\/or customs clearance (as well as any ancillary costs, of any nature) shall be borne by the buyer.
\n12. RIGHT OF WITHDRAWAL
\nThe buyer may withdraw from the contract within 10 working days from receipt of the goods, pursuant to Articles 55 and 64 et seq Italian Legislative Decree dated 6 September 2005, No. 206 (\u201cConsumer Code\u201d).
\n13. EXERCISING THE RIGHT OF WITHDRAWAL
\nShould buyer intend to withdraw from the contract, he must provide notification of such by way of recorded delivery letter with acknowledgement of receipt sent to Album di Famiglia, in Lomazzo (CO) in Via Del Ronco 12, and return the goods to the company within 10 days from the date of delivery.
\nThe goods must be returned to Album di Famiglia intact, complete with any accessories, with the original labelling and packaging; withdrawal from the contract shall not, therefore, be permitted where items have been damaged or even just used, where the labelling has been altered or removed or in any case where the items are not in the same condition in which they were sent to the buyer.
\nThe costs of returning the goods to Album di Famiglia shall in any case be borne entirely by the buyer.
\n14. RETURN OF THE PRICE
\nIn caso di legittimo esercizio del diritto di recesso, Album di Famiglia rimborser\u00e0 all\u2019acquirente il prezzo della merce fornitale \u2013 con esclusione delle spese di spedizione e gli eventuali ulteriori costi sostenuti (ivi inclusi quelli indicati al punto 10) -, entro 30 giorni dal ricevimento della merce.
\nNulla sar\u00e0 dovuto se il diritto di recesso fosse esercitato dopo la scadenza dei termini previsti al punto 11 o la merce non fosse restituita nelle condizioni previste al punto 12.
\n15. PARTIAL WITHDRAWAL
\nThe buyer may exercise the right of withdrawal even for just part of the ordered goods.
\nIn that case, the buyer must identify, within the declaration of withdrawal, the individual goods for which the right of withdrawal is to be exercised and must return them to Album di Famiglia.
\nAlbum di Famiglia must consequently refund to the buyer only the cost of the returned goods.
\n16. COMPLAINTS
\nAny complaints must be sent by way of recorded delivery letter with acknowledgement of receipt to Album di Famiglia in Lomazzo (CO) in Via Del Ronco 12.
\n17. MEDIATION
\nAny disputes between the seller and the buyer may be settled by way of recourse to the mediation procedure set out by the Consumer Code (Italian Legislative Decree No. 206\/2005).
\n18. ASSISTANCE
\nBefore or after finalisation or implementation of the contract, the buyer may request assistance from Album di Famiglia by telephone on +39 02 96342357, by email at shop@albumdifamiglia.com or by post, by way of recorded delivery letter with acknowledgement of receipt to Lomazzo (CO) in Via Del Ronco 12.
\n19. BUYER\u2019S RIGHTS
\nAs a consumer pursuant to Italian Legislative Decree No. 206\/2005, the buyer has the rights contained in Chapter I, Section II, Italian Legislative Decree No. 206\/2005.
\n20. ACCOUNT PROTECTION
\nThe buyer is obliged to keep his login and password secret and, in general, to take all necessary precautions to prevent unauthorised access to the site by way of his account; in the event of a breach of this secrecy, the buyer is obliged immediately to inform Album di Famiglia of such.
\nThe buyer is in any case responsible for all activities that are carried out, even by unauthorised third parties, on his account and with his password.
\n21. PRIVACY
\nBy sending the order, the buyer authorises Album di Famiglia to process his personal data, solely for the purposes of processing the order and registering the sale in the accounts.
\nThe buyer may correct any errors in data entry and may alter his personal details by logging in to the website.
\n22. LANGUAGE AND APPLICABLE LAW
\nThe contract may be finalised in Italian or English; in any case, only the Italian text of the contract shall be relied upon.
